While so called tort reform rhetoric continues to be heard from politicians especially among republicans, the reality in the marketplace stands in stark contrast to the claims being made by the advocates for reform. Major insurance companies continue to routinely deny claims in bad faith. According to badfaithinsurance.org, Allstate and State Farm are consistently among the worst insurers. Many insurers may adopt a practice of routinely denying legitimate claims knowing that the majority of claimants will not fight the practice and simply go away. In this way a bad faith insurer will save millions of dollars. The few claimants who fight the practice will barely make a dent in the amounts wrongfully withheld from legitimate claimants."
